From Antiquity until recently, philosophers and mathematicians have continually discussed the concept of angle and its relation to archimedean and non-archimedean theories of measurement. For the first time, this book traces the history of these discussions in Greek and Arabic, from Euclid to Kamāl al-Dīn al-Fārisī, after whom the discussion was not resumed until Newton and Euler. The volume presents first editions of over twenty texts, either in Arabic or Greek and translated into Arabic, of the greatest mathematicians and philosophers (...) of the time. The texts are here translated into French and supplemented with extensive commentary. The book begins with the definitions and propositions of Euclid on angles and measurement, followed by the Greek commentary tradition represented by Proclus and Simplicius (only extant in Arabic) and the writings of the Arabic mathematicians and philosophers from the 9th through 14th century, placing the fundamental contributions by Avicenna and Ibn al-Haytham into their historical context and showing how numerous successors produced new syntheses of their work. ʿImād al-Dīn Ibn Kathīr (d. 774/1373), is an important historian, mufassir, muhaddith and Shāfiʿī jurist who lived in the 8th century. Ibn Kathīr’s work titled Tafseer al-Qurʾān al-ʿAẓeem, beside its tafsir identity, can be utilized due to its rich ḥadīth content and its comments on isnad and text of the ḥadīths. Ibn Kathīr, due to his competency in history and ḥadīth, analyzed the ḥadīth rigorously and noted any necessary aspect regarding the isnad or the text. In this paper, the analysis (...) and criticism of ḥadīth texts in Ibn Kathīr’s tafsir is examined. Regarding the analysis aiming to understand the meaning of the ḥadīth, issues such as explanation of unknown words, utilizing the chapter headings, evaluation of all related ḥadīths, comments of previous scholars as well as Ibn Kathīr’s original interpretations are examined. Regarding the criticism of the text, issues such as general criticism under the heading of munkar which indicates a ḥadīth the text of which contains unacceptable meanings, specific criticisms due to conflict with the Qurʾān, the Sunnah, reasoning and historical facts, solutions regarding the ḥadīths which have conflicting meanings are examined. Summary: Ibn Kathīr (d. 774/1373) who lived in the 8th century is a competent scholar in fields such as ḥadīth, history, tafsir and jurisprudence. In this article the criticism and analysis of ḥadīths in the Tafseer al-Qurʾān al-ʿAẓeem by Ibn Kathīr who is an authority in ḥadīth and history are studied. Although the structure and plan of this book do not give it an appearance of a classic ḥadīth commentary, the rich ḥadīth content which it has, and the examination of this content with respect to isnad and text as in a ḥadīth commentary provide this book a ḥadīth commentary identity besides its tafsir identity. Ibn Kathīr’s tafsir is distinguished among other tafsirs by the ḥadīth commentary method and ḥadīth criticism that it employs. This is because it does not only provide ḥadīths as is seen in many other tafsirs, but also informs about the important issues that need to be known about these ḥadīths, and even in many times makes original evaluations. It is possible that Ibn Kathīr provides important evaluations about a ḥadīth which other famous commentators do not provide. He corrects some of the great ḥadīth scholars by showing the presence of isnads for ḥadīths that these scholars think do not exist. With all these aspects, Tafseer al-Qurʾān al-ʿAẓeem is an invaluable source for both tafsir readers and ḥadīth scholars due to its rich ḥadīth content, the skillful application of ḥadīth methodology and ḥadīth commentary. Ibn Kathīr’s tafsir is also an important ḥadīth source due to its very rich ḥadīth content. According to the catalogue at the end of the book, it includes over eight thousand ḥadīths which corresponds to a content similar to that of Ṣaḥīḥ al-Bukhārī. Looking at the studies over Tafseer al-Qurʾān al-ʿAẓeem, it can be said that it has been subject to many examinations with respect to tafsir, however, it has not received the same attention with respect to ḥadīth at a sufficient level. It is aimed in this study on one side to prove the value and originality of Tafseer al-Qurʾān al-ʿAẓeem as a ḥadīth commentary and on the other side to attract attention to the text criticism activities of ḥadīth scholars by using both specific criteria and concepts such as munkar.In our study the criticism and analysis of ḥadīth texts in Ibn Kathīr’s tafsir are studied under various headings. It is quite important to identify possible mistakes in ḥadīth texts as well as to understand the ḥadīth texts correctly. For this purpose the principles of text criticism such as conflict with the Qurʾān, the Sunnah, reasoning and historical facts have been used since the time of the Companions. Ibn Kathīr has approached ḥadīths in view of these text criticism principles and pointed to the mistakes in the texts of the ḥadīths which are in conflict with these principles. Often times, Ibn Kathīr criticized the points in ḥadīth texts which are not in line with the general principles of Islam and which he perceived not appropriate by using the term munkar in a general manner. He utilized this concept explicitly for isnad and text. He always warned the reader against baseless information. Finally, he pointed out to instances which can be determined as a result of the comparison of the various channels of a ḥadīth. Text analyses are efforts to correctly understand the ḥadīth text which enable to clarify the meaning of the ḥadīth. Efforts such as the explanation of the unknown words, the evaluation of all the ḥadīths related to a subject in a unified manner, making use of another ḥadīth in understanding of a ḥadīth, making using of the opinions of the previous ḥadīth scholars and making original interpretations, identification of the unknown persons in the text, making connections with the chapter headings to better understand the meaning, explanations of the contradictions arising from different ḥadīths and collecting different historical ḥadīths in a common theme contribute to a better understanding of the meaning of ḥadīths. It can be seen clearly how Ibn Kathīr applied these text analyses with success through sample ḥadīth texts selected from his tafsir.Two points that we think important are underlined at the end of our study. First, it is the exceptional position of Tafseer al-Qurʾān al-ʿAẓeem among the Qurʾān tafsirs with respect to ḥadīth content and analysis. When compared with the famous tafsirs that emerge in the tafsir history, Ibn Kathīr’s tafsir is easily distinguished. When the importance of ḥadīth in the Qurʾān tafsir is thought, it is important that the ḥadīth material is filtered with respect to its authenticity and the meaning of the ḥadīth is clarified at a sufficient level. Compared to the limited number of ḥadīths in the famous tafsirs that are used to explain the verses, the rich information with respect to isnad and text in Tafseer al-Qurʾān al-ʿAẓeem makes significant contribution in the explanation of the verses and provide the reader with valuable ḥadīth knowledge.The second point that we think is important is that the text criticism efforts seen in Tafseer al-Qurʾān al-ʿAẓeem help to correct the opinion that ḥadīth scholars ignored text criticism compared to isnad criticism. In this respect, it is evaluated that our study is a contribution to the recent studies that shed light on the text criticism efforts of the ḥadīth scholars. In this regard, it seems important to make use of a criterion such as “conflict with the inner consistency of a ḥadīth” among other criteria. Moreover, it is pointed out in our study that the munkar concept and the thesis that this concept has been utilized by ḥadīth scholars in text criticism, is a topic which attracted the interest of the researchers and the usage of this concept in Ibn Kathīr’s tafsir contributes to this thesis. The "Text" and the "Commentary" mentioned in the title of this essay are, respectively, the "Kitāb al-Manāẓir", or "Optics", of al-Ḥasan ibn al-Haytham, composed in the first half of the fifth/eleventh century, and the "Tanqīḥ al-Manāẓir li-dhawī l-abṣār wa l-baṣā'ir", written by Abū l-Ḥasan (or al-Ḥasan) Kamāl al-Dīn al-Fārisī in the second half of the seventh/thirteenth century. It is known that, so far, only the first five of the seven "maqālāt"/Books that make up the Arabic text of IH's "Optics" have (...) been published, and that the "Tanqīḥ" was published in two volumes. The mutakallimūn, who began to take care of nature as a result of their metaphysical concerns from the early period and with the influence of the dualist and materialist groups, suggested various theories that attempt to explain the structure and functioning of the universe. Over time, many subjects of physics became an indispensable part of Kalām and were used in the proof of the fundamental principles. Thus, in addition to the definition of body (jism), Kalām books began to contain detailed (...) topics such as time, space, movement and distance. After summarizing the definitions of body, which were made by the mutakallimūn, this article will examine the contents of Ibn Kamāl's epistle on ṭafra (leaping), which has many copies with various titles in the Turkish Libraries. In the beginning of the epistle, Ibn Kamāl mentions the descriptions of body suggested by the prominent mutakallimūn, and then, he compares the views of al-Naẓẓām, who believes in the finite division, with atomist mutakallimūn who accept the infinite division. He criticizes the idea of ṭafra with regard to the notion of body in Kalām. After explaining the arguments of both groups with their justifications, he points out the weaknesses of the arguments of each group, as well. In this connection, he revisits the theory of ṭafra, which is, he argues, a mandatory consequence of al-Naẓẓām’s definition of object, as he also reviews the opinions of Quṭb al-Din al-Rāzī in this direction. al-Zarkashī, an ethnic Turk, is an important hadith, fiqh and commentary scholar who lived during the Mamlūks period. He was taught by some of the leading scholars of his era, such as Alā al-Dīn Mughultay (d. 762/1360), Imād al-Dīn Ibn Kashīr (d. 774/1372) ve Jamal al-Dīn al-Asnawī (d. 772/1370), and he grew up under their mentorship. Nevertheless, his only well-known student is Birmāvī (d. 831/1428). Almost half of his works have been related to fiqh and methodology of fiqh, and he (...) has also written some important works in the field of hadith. Among these, especially al-Tadhkira, al-Nukat alā Ibn al-Salāh, al-Nukat alā al-Umda fī al-Ahkām ve al-Icāba are worthy of mention. The work named al-Tadhkira, which we built our work upon, is the first known work to have been preserved in the field. Due to his being a first in his field, he was vastly studied as to how he evaluated the narrations and what kind of procedure he followed. In this work of his, not only the criticism but also the application of the text criticism adds to the importance of the work. Then, on the basis of this work, scholars such as al-Sakhāwī and al-Aclūnī made complementary works on the same subject. Summary: It is inevitable for a person to be shaped by the society he lives in. During the time when al-Zarkashī lived, Egypt was under the rule of the Mamlūks. The history of Mamlūks is examined under two periods: 1. Bahrī or Turkish Mamlūks (745 / 1344 - 794-1391) 2. Burjī or Circassian Mamlūks (784 / 1382 - 923 / 1517) period. Our author lives in both periods. About forty years of his life was in the period of Bahrī and the rest was in the period of Burjī. In both periods, the state did not have a full political authority in the country, but this was not the case in education and training. In fact, on the contrary to the political situation, scientific activities have accelerated by the arrival of many scholars to the land of Mamlūk because of the Mongol invasions coming from the east and the Crusades from the west. The increase of scientific activity was caused not only by the coming of the scholars but also by the support given by the Mamlūk sultans. In fact, they built many new madrasas in addition to the resurrection of the old ones. In addition to madrasas during the Mamlūks period, mosque, hāngāh, ribat and zāwiya are also among the educational places.Hadith, fiqh and Tafsir scholar al-Zarkashī is originally Turkish. He was born in Cairo at 745 under the conditions mentioned above. His family learned of gold and silverworking because of their subsequent settlement to Egypt, and they made their living with this craft. A person who performs this is called Zarkash in Arabic. Muhammad ibn Bahādır, who learned and did this job, was known as al-Zarkashī. al-Zarkashī, known for his love of science since childhood, was trained hadith by Alā al-Dīn Mughultay (d. 762/1360) and Imād al-Dīn Ibn Kashīr (d. 774/1372) in Damascus, and fiqh by al-Asnawī (d. 772/1370). Among his beneficiaries are distinguished personalities such as al-Subkī (d. 756/1355), al-Azraī (d. 783/1381) and al-Bulqīnī (d. 824/1421). The most remarkable of his student is al-Birmāvī (d. 831/1428).It is known that he wrote about fifty works in hadith, tafsir, fiqh, methodology of fiqh and other fields. Especially among these works al-Burhān fī ʻUlūm al-Qur’ān, al-Tadhkira, al-Ijāba, al-Bahr al-Muhīt fî Usūl al-Fiqh ve al-Mansūr fī al-Qawāid is worth mentioning. Studies on al-Burhān and al-Bahr were carried out at the level of Master and PhD.al-Zarkashī did not hesitate to criticize any person for whom he had found his mistake. For example, even though he has a great love for him, and even because of this love, he has been given the name of al-Minhāj, the criticism of al-Nawawī is the clearest indication of the value given to science. Not just him, critics of scholars such as al-Hākim al-Naysābūrī and Ibn ʻAbd al-Barr who are recognized as authority in hadith can also be considered in this framework.The work named al-Tadhkira which we have studied in our work is of importance in that it shows the accumulation of knowledge in the field of hadith. In order to compose this work, it is necessary to have enough information in this field since the riwāyas must be criticized in terms of isnād and text. To compose his work, al-Zarkashī has benefited from about a hundred and forty works related to hadith, tafsir, al-siyar, history, tabakāt, commentary, jarh - taʻdīl, ilal and maghāzī. The use of such works is an effort to reach all sources and right information as much as possible. Some of these sources are basic hadith books such as al-Bukhārī (d. 256/870) al-Sahīh, Muslim (d. 261/875) al- Sahīh, Abū Dāʾūd (d. 275/889) al-Sunan, al-Tirmidhī (d. 279/892) al-Sunan, al-Nasā’ī (d. 303/915) al-Sunan, Ibn Mādja (d. 273/887) al-Sunan, Mālik ibn Anas (d. 179/795) al-Muwatta, Ahmad ibn Hanbal (d. 241/855) al-Musnad, al-Dārimī (d. 255/869) al-Sunan, ʻAbd al-Razzāq al-Sanʻānī (d. 211/826-27) al-Musannaf, Ibn Abī Shayba (d. 235/849) al-Musannaf, Ibn Rāhwayh (d. 238/853) al-Musnad, al- Bazzār (d. 292/905) al-Musnad, Abu Yaʻlā el-Mawsilī (d. 307/919) al-Musnad, Ibn Hibbān (d. 354/965) al-Sahīh, al-Tabarānī (d. 360/971) al-Muʻjam al-Awsat and al-Muʻjam al-Kabīr, al-Hākim al-Naysābūrī (d. 405/1014) al-Mustadrak.al-Zarkashī divided the riwāyas he had studied into eight subjects. These are judgments, wisdom, zuhd, medicine, virtue, prayer, story, words and riwāyas circulating in language. He shares the information he obtains from sources about him after mentioning the riwāyas he will examine. For example, it is mentioned that there is not a hadith which is transmitted as a hadith, it is a word of a sahāba, tābiun or a person. He transferred on the riwāyas the sources mentioned in the sources, but also stated that he did not participate in some information as the place came.The author has evaluated the narrators of the riwāyas from the point of jarh and taʻdīl. He did not only evaluate riwāyas in terms of isnād, but also text criticism. This activity is a distinctive feature of his work.al-Zarkashī gave information about the misrepresentation of the name of the narrators. He also explained the strange words that are difficult to understand in the text. It is a manifestation of his knowledge in the fiqh area that some of the riwāyas that are considered weak are expressed in some sects. The author described some errors about the riwāyas. For example, he stated that a riwāya that is said to be marfūʻ is a mavkūf. al-Zarkashī also included verses, hadiths and poems about the riwāya that he had studied while writing his work or he defended it by saying that it is not the case of a riwāya that is said to be fictitious.Perhaps it is the weakest point of al-Zarkashī’s work not to give any information about some riwāya, only to mention their isnāds. He also found some riwāyas that did not have a reliable isnāds and stated that their meanings are correct. This knowledge has become an enlightening characteristic for later generations.This work has a great significance in showing that the majority of the riwāyas that spread among the people are not hadiths. As a matter of fact, 73% of the riwāyas examined in the work are weak or irrelevant riwāyas. This work of al-Zarkashī is unique. The existence of such a work has not been determined before him. This work constituted the basis of the works written by scholars such as al-Sakhāwī and al-Aclūnī in the same subject after him. (shrink)

Kamal al-Dīn al-Andijānī is one of the lesser-known Māturīdī theologians who lived in the eighth century. He has a work titled Sıdḳ al-kalam fi ilm al-kalam that has survived. In the work, which was written within the framework of usul al-salase, answers are given to those who have opinions other than the Ahl as-Sunnah, and the views of the Ahl as-Sunnah are tried to be proven. In the work, subjects related to jinns are also included, and the subject is explained (...) with different examples and events. In this article, Andijani's views on jinn are discussed, and these views are tried to be evaluated in the light of classical and current sources. Not many studies have been done on Andijani. Therefore, the scientific world does not know him well enough. In addition, his views on jinn are perhaps not known at all. In this respect, we believe that our study will fill this gap to some extent. Literature review, comparison, and concept analysis methods have been used in the study, and the subject has been limited to Andijani's Sıdḳ al-kalam. Considering Andijani's claim that he dealt with the views of Ahl al-Sunnah with solid evidence and concisely, it is clear that his views reflect the views of both the Māturīdis of the time and the scholars of Ahl al-Sunnah in general. In order to evaluate Andijani's views in a correct way, first of all, the concept of jinn and the pre-Islamic jinn perception are mentioned in the article. The way in which the Qur'an deals with the subject of jinn and the determination of its purpose constitutes our most important pillar that gives the main perspective to our study. In this context, it can be said that the concept of jinn encompasses all beings that cannot be perceived by the five senses. It is seen that the pre-Islamic jinn perception affected people's lives in different layers, from fear to worship. Fear caused by lack of knowledge can either end with the elimination of incomplete knowledge or by taking shelter or worshiping the feared entity. In pre-Islamic societies, sheltering or worshiping the feared entity was preferred. This preference resulted in people seeing the jinn as superior to themselves, taking shelter in them or worshiping them. On the other hand, it is possible to say that the narratives in the Qur'an about jinn are aimed at creating a solid foundation of knowledge that removes people's fear of jinn. In this framework, when Andijani's views on jinn are evaluated, it can be determined that he focuses on two issues, namely the basic characteristics of jinn and their religious status. In Andjijani's understanding, it is seen that jinn are described as beings invisible to humans, able to enter human bodies, affect them, eat, drink and change shape. Andijani also announced opinions about the religious situation of the jinn. According to him, jinn can also belong to non-Islamic religions. In terms of belief and practice, they belong to many sects. Andijani expressed his views also on the situation of jinn in the hereafter. Even if sinful believers of the jinn die without repentance like humans, Allah can forgive them before or after punishment. According to Andijani, there is a difference of opinion among Hanafis and Māturīdis regarding the situation of the faithful believers of the jinn in the hereafter. Andijani includes the views of Abū Ḥanīfa, Abū Yusuf and Imam Muḥammad, who put forward opposing views, and explains the evidences of both sides. He ends the subject without expressing his own opinion. When Andijani's views are considered in terms of the purpose of the Qur'an in dealing with the jinn, it is understood that he accepted this information as a kind of news "fâide-i haber", which is only to provide information and the first time heard by the addressee. However, the news of the Qur'an about jinn is of the type of news "lâzım-ı fâide-i haber", which aims to teach another lesson on the information that the addressee was previously aware of. Therefore, the purpose of the expression in the news about jinn is important, not the apparent purpose, but revealing another situation. It can be said that Andijani made evaluations on the mythological jinn perceptions of the Arabs and remained at that level, the information and evaluations he gave did not include the main message that the Qur'an wanted to give, and left many areas to be explained. The message that the Qur'an wants to convey through the beliefs of the Jahiliyya Arabs about jinn is to reinforce tawhid, to emphasize that humans are stronger beings than jinn. While there are messages brought by the Prophet Muḥammad, there is no need for news that are thought to be stolen by vile creatures such as jinn. (shrink)

The law of responsibility (compensation), which was formed around the concept of the ḍamān and was developed by the scholars within the system of furû‘ al-fiqh (substantive law) over time, constitutes one of the important parts of Islamic law. Although compensation law (ḍamān) was not addressed as a private subject in the first period fiqh literature, it is seen that the literature on this specific area started to emerge after the early period. It is the Hanafi jurists who first brought (...) together these issues that are scattered in the classical books of fiqh that are related to the law of responsibility. Compensation law took its classical form in the texts of the early periods and was shaped around the views of the founding imams of the Ḥanafī school (madhab). It has later been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Hanafi in the type of waqi'at works. These works were a product of the need for the law to adapt to the new conditions. These issues, which are related to the compensation law in the Hanafi school have been covered as a special section (chapter) in the studies that are classified as waqi'at, such as Usrūshanī’s al-Fuṣūl fī al-muʿāmalat (Fuṣūl al-Usrūshanī), ʿImād al-Dīn al-Marginānī’s Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn’s Jāmiʿal-Fuṣūlāyn. Later, the topics discussed in these works were developed and continued, and ultimately separate works related to this field have been copyrighted. In this study, the kinds of development and expansion which are in the literature and related subjects will be discussed by examining the above-mentioned works. Therefore; first of all, the first examples of Hanafi jurists related the compensation will be analysed comparatively. Afterwards, the place of ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah of Fuḍayl Chalābī (d. 991/1583), one of the Zenbillizade’s, will be addressed.Summary: The core idea of the law of responsibility, which constitutes one of the important parts of Islamic law, was stated in the Qur'an and Hadith, and then have accumulated by the contributions of the jurists (fuqaha), as they developed the idea of the law of responsibility within the furû‘ al-fiqh in relation to the systematic of the legal school (madhab) that they belonged to.These issues, which constitute one of the important parts of the law, were addressed by sprinkling among the topics in almost every part of classical fiqh books. In other words, the subject of ḍamān (responsibility) was not considered as a separate subject in the fiqh works of the first period. In this way, it is seen that the literature on compensation law started to emerge in the following periods, and at first several independent sections on this subject, and then separate works specific to this field, albeit limited in number, were written.It is the Ḥanafī jurists who first brought together these issues that are scattered in the classical fiqh books related to the law of responsibility. Compensation law, which took its classical form in the texts from early periods, shaped around the views of the pioneering imams of the Ḥanafī school, has been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Ḥanafī in the waqi'at works, which is a product of the need for the law to adapt to new conditions. Firstly, one of the Ḥanafī jurists, Majd al-Dīn al-Usrūshanī (d. 637/1240) dealt with the responsibilities arising from the contract and unfair acts in the 29th section of his book named al-Fuṣūl fī al-muʿāmalat under the title “Types of Compensation Required to be Paid and Their Situation”. The method and system that Usrūshanī started in this work, the Ḥanafī jurisits ʿImād al-Dīn al-Marginānī in the Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn Ibn Qāḍī Samāwnā in the Jāmiʿ al-Fuṣūlāyn continued to develop the compensation section in their books. Afterwards Fuḍayl Chalābī (d. 991/1583), one of the members of Zenbillizade’s family, enriched these issues and made it an individual work, named ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah. Marginānī titled the issues that Usrūshanī had handled in the compensation section and systemised it even more by gathering the fatwās on the related issues under one heading. It is noteworthy to mention that when the compensation sections of both works are compared, the way the subjects handled are exactly the same. But unlike Usrūshanī, Marginānī added the compensation for damages to the fetus in the womb and the responsibility of the person who brought back the fleeing slave at the end of the chapter. On the other hand, unlike them, Shaykh Badr al-Dīn added only the responsibility of the person who found the lost item. Considering that almost all of the topics in the compensation section of Sheikh Badr al-Dīn existed exactly in the compensation section of Marginānī, and that most of them were stated in Usrūshanī’s al-Fuṣūl, it is necessary to say that all of these discussions are based on Usrūshanī as the main backbone of this particular subject and that his work has a unique place in the Islamic legal literature. Chalābī’s ad-Ḍamānāt, is the first work that was written as a separate book in the field of compensation law. Even though in some modern works claim that the work Ghānim al-Baghdādī’s (d. 1030/1620) book named Majma‘ al-ḍamānāt fī madhhab al-Imām al-A'zam Abī Ḥanīfa al-Nu'mān was the first written book in this field; it is known that Chalābī's ad-Ḍamānāt had been written before Baghdādī’s Majma‘ al-ḍamānāt. As a matter of fact, the work of Chalābī had been completed in 984 Hijra, and the Baghdādī’s Majma‘ al-ḍamānāt was completed in 1027 Hijra. Although the subject sequence in Baghdādī’s work is different; this work is regarded as a continuation of the same tradition.An examination of the systematic and the content of the work reveals that Chalabi’s ad-Ḍamānāt is the continuation of the type of writing that Usrūshanī started and developed by Marginānī and Shaykh Badr al-Dīn. When compared with the compensation sections of these works before him, Chalābī has added new compensation issues to his book that are not addressed in these three works; such as partnership, mudaraba, suretyship (kafāla) transfer (ḥawāla), peace, legal disability (hajr), freedom of trade (idhn) and testament. Among the works mentioned above, works out of Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn and Baghdādī’s Majma‘ al-ḍamānāt are available as manuscripts in the libraries. Therefore, these works have not been used much in modern studies on compensation. In addition, the Chalābī's ad-Ḍamānāt is almost unknown. Although there is little information about this work in some bibliographic studies, it is noteworthy to state that this work is not used as a source in contemporary studies written in Arabic on compensation law. The fact that this work is available as manuscripts in Istanbul libraries is probably the reason for this outcome. It is also very difficult to say that this work is known and used sufficiently in studies written in Turkish.Usrūshanī’s al-Fuṣūl fī al-muʿāmalat and Marginānī’s Fuṣūl al-iḥkām are currently in the form of manuscripts, so there is no comprehensive study on the whole work and the compensation section. It is possible to see the compensation issues discussed in the work, since Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn, which has been published as printed, was translated into Turkish by an editorial group under the presidency of H. Yunus Apaydın. In addition, Kemal Yıldız, who translated the compensation section in this translation, published this section in Jāmiʿal-Fuṣūlāyn as a separate book with the name of “Sources of the Jāmiʿ al-Fuṣūlāyn and Compensation in the Practice of Ḥanafī School”. Yıldız, first introduced the sources of the Jāmiʿ al-Fuṣūlāyn in the first part of this work and then translated the compensation section from beginning to end by adding his own explanations and evaluations around the subject during the second part. Even though some introductory information about the books of Usrūshanī and Marginānī is presented in Yıldız’s study, the absence of information on the contents of the compensation sections of these books does not allow the opportunity for the researchers to evaluate on the subject wholly. A contemporary to Thomas Aquinas in Latin Catholic Italy, and with a parallel motivation to stabilize each his own civilization in its flux and storm, 'Abd Allah Baydawi of Ilkhan Persia wrote a compact and memorable Arabic Summation of Islamic Natural and Traditional Theology. With the same strokes of his pen he presented the Islamic version of the Science of Theological Statement, bafflingly called "Kalam" while familiarly embracing "Theology". Baydawi's Tawali'al-Anwar min Matal'al-Anzar (Rays of Dawnlight Outstreaming from Far Horizons of (...) Logical Reasoning), with Mahmud Isfahani's commentary, is a formidably clear logical and mental vision of mankind's final completion as a spiritual structure in Islam. Reality - in nature's Possible mode, in an apodictic Divine mode, and in humanity's heroic Prophetic mode - comprises man's Worldview and is the Theme of the Baydawi/Isfahani discourse. In the study of the history of Islamic philosophy, most researchers have focused on certain distinguished figures and/or periods during which some highly remarkable developments took place. It is probably for this reason that until very recently the period between Naṣīr al-Dīn Ṭūsī (597/1201–672/1274) and Mullā Ṣadrā (ca. 79/1571–1045/1636 or 1050/1640) attracted relatively little attention — it was almost commonly believed that, due to certain unfavorable historical circumstances, philosophical thought made few, if any, major breakthroughs during these three centuries. The autograph corpus of the Damascene scholar Ibn Ṭūlūn is dispersed throughout collections in North America, Europe, and West Asia. As an initial probe into these materials, I will describe, identify, and analyze two compendia in the Princeton University collection: Garrett MSS 196B and 1011H. They contain, among other things, a portion of al-Thaghr al-bassām, an autograph draft of his biographical dictionary of Damascene judges, which is later than the one edited and published in 1959, and a heretofore missing portion (...) of al-Qalāʿid al-jawhari- yya, his topography of al-Ṣāliḥiyya. I will also positively identify an anonymous, untitled manuscript in the Bodleian Library and show its relationship to the al-Thaghr al-bassām autograph. (shrink)

This article revisits the controversy between Abū Bakr al-Rāzī and Abū al-Qāsim al-Balḫī. Based on the testimony of the Kitāb taṯbīt dalāʾil al-nubuwwa of the Qāḍī ʿAbd al-Ǧabbār, it is shown that the two philosophers must have clashed at the court of Aḥmad b. Sahl al-Marwazī, governor of Balḫ, during the 910s, and that the virulence of the tone of their exchange can be explained above all by this context of professional rivalry. In terms of content, their conversation must have (...) focused on the question of divine justice and on the best way to give an account of prophecy and Qurʾanic wisdom. We then turn to the study of chap. VIII, 4 of Faḫr al-Dīn al-Rāzī's Al-maṭālib al-ʿāliya and show that, contrary to a recently held view, this chapter constitutes an echo not of Abū Bakr al-Rāzī, but of the first argument of Ibn al-Rāwandī's Kitāb al-zumurrud, which contrasted the autonomy of reason with the necessity of prophecy in order to conclude from the former to the negation of the latter. Finally, it is suggested that Abū Bakr al-Rāzī's doctrine of prophecy, like that of the great theologians of his time, both Muʿtazilites and Ašʿarites, aims to escape the dilemma set up by Ibn al-Rāwandī a few decades earlier. El proceso de Ibn al-Japó ha pasado a la historia debido a la personalidad del incul-pado. La mayoría de las opiniones coinciden en declarar la acusación y el proceso como un simulacro para conseguir su muerte, pues la acusación de alta traición, por las cir-cunstancias que incidieron en el caso, no iba a conseguir el objetivo propuesto. Por esta razón se buscaron otros motivos con que inculparle y que permitieran perseguirlo y con-denarlo en cualquier parte del Islam, por eso estas (...) acusaciones sólo podían responder a delitos de lesa religión. Y se encontraron. Las acusaciones que se analizan en este traba-jo figuran en varios textos, en al-Marqaba al-`ulya y en las obras de al-Maqqari, algunos de ellos no traducidos hasta ahora. En el desarrollo de las actuaciones se observan irregu-laridades procesales, pero tanto en Granada como en Fez, la condena se centra en la figu-ra del zindiq cuya sentencia final fue la pena de muerte. ABSTRACT The trial of Ibn al-Khatib has left its mark on history because of the personality of the accused. Most scholars in the past Nave thought that his accusation and subsequent trial on religious grounds were no more than excuses intended to bring about his death, as a trial for high treason would, for various reasons, not have been possible. For this he had to be accused of crimes against religion as this was the only sure way of mounting a successful case against him. The accusations analysed here are taken from a variety of sources including Al-Marqaba al- `ulyá and the works of al-Maqqari, some of which have not been translated before. We notice procedural irregularities in the course of the trial, but both in Granada and in Fez the focus is on the zinddq who is 6nally condemned to death. (shrink)

This text is a bilingual Arabic-English translation of one of the most important metaphysical works of the Persian Muslim philosopher known as Mulla Sadra & Sadr al-Din Muhammad al-Shirazi. In this work Mulla Sadra develops an anti-Platonic philosophical position which is non-Aristotelian. He holds that "existents" are ontologically prior to "essence" & that there are two different realms -- the mind dependent domain & entities which exist independent of the mind. Mulla Sadra's views became very popular among Iranian Muslim philosophers (...) & eventually were instrumental in destroying the Aristotelian school of thought in the Islamic world. The translator, Dr. Parviz Morewedge, is the Secretary-Treasurer of the Society for the Study of Islamic Philosophy & Science & has published ten books & numerous articles in Islamic Philosophy & Mysticism. During the Mamlūk period (648-923/1250-1517), some developments such as the support of the state dignitaries for scholarly activities, the interest of the ʿulamā to the Mamlūk geography and the establishment of many scientific institutions increased the interest in scholarly activities in society. In this period of intensive scholarly activities, women also started to increasingly take part in this field, and as a result, many female scholars were trained. The fact that women scholars were encountered among the teachers of the famous (...) scientists of the period is a clear proof of this situation. As a matter of fact, the teachers of Najm al-Dīn Ibn Fahd, one of the famous muḥaddiths and historians of the 9th (15th) century, set an obvious example for this. Sixty-seven of his four hundred ninety-seven teachers were women. Najm al-Dīn Ibn Fahd, a member of a prominent ʿulamā family of Mecca, traveled to different cities in the Mamlūk geography and took lessons from many teachers, men and women. What is more valuable for our subject is that he wrote a work called Mu’jam al-shuyūkh, which contains extremely important information about his teachers. This article tries to assess women's participation in scholarly activities and social positions in Mamlūk society, based on his female teachers. This work, made up of two parts, first deals with women’s opportunities to pursue academic studies and their subsequent contributions to science. The second part is about their position in social life which stemmed from the families they belonged to and from their marriages. In this article, in which sixty-seven female scholars of Najm al-Dīn Ibn Fahd are discussed, some important results have been reached. This look into his sixty-seven female teachers shows how widespread women’s relationships with scholarly circles were in Mamlūk society, and that especially girls of families with scholarly traditions were included in academic circles from a young age. These girls were able to get their initial education from close relatives and then they were able to connect to academic circles easily via family relationships, taking courses with many scholars including women. Women have been instrumental in the transfer of knowledge more so than its production. Their efforts both during their studies and as scholars were focused on ḥadīth transmission. It is difficult to pinpoint the exact reason why ḥadīth sciences were the focus, but one can say that the ubiquity of ḥadīth sessions and their ease of accessibility must have been a factor. It is seen that young girls who participated in these sessions were encouraged to study with older scholars, thereby acquiring a strong isnād chain and becoming a source of information in later years for the transmission of knowledge. However, it is hard to say that every woman who got some education took a role in knowledge transmission. One can even claim, based on Najm al-Dīn Ibn Fahd’s female teachers, that a lot of women in academic circles did not take a role in knowledge transmission as scholars, despite their potential. The fact that no official institutions are mentioned with regard to women’s acquisition and transfer of knowledge may be indicative of the importance of teacher-student relationships rather than institutions, or, it can be that women were more active outside of these official institutions. Also, the fact that most of Najm al-Dīn Ibn Fahd’s female teachers were all taught by several common teachers shows the liveliness of academic activity outside of official institutions. There is very little narration regarding the social lives of women who were engaged in scholarly activities. Among the most important reasons why this is so is the desire to put their scholarly competencies to the forefront. However, it is possible to get some information about their families and marriages for many of them. One can see that Najm al-Dīn Ibn Fahd’s female teachers generally married men who were also engaged in scholarship. The fact that women, especially those in the scholarly class, married from among their relatives must have been related to this. All of the married women except one have at least one child. While divorce is not too common, marrying again as a result of the death of a husband or as a result of divorce is not rare. (shrink)

Sadr al-Din Muhammad Shirazi (1572-1640), more commonly called Mulla Sadra, was one of the grand scholars of later-period Islamic philosophy and has grown to become one of the best-known Muslim philosophers. Iksir al-'arifin, or Elixir of the Gnostics, is unique among Sadra's writings in that it reworks and amplifies an earlier Persian work, the Jawidan-nama ( Book of the Everlasting ) by Afdal al-Din Kashani, or Baba Afdal. The underlying theme of Sadra's amplification is emblematic of Muslim philosophy: the importance (...) of self-knowledge in an individual's journey of "Origin and Return," the soul's origins with God and its eventual return to Him. Everything, Sadra says, is on such a path, gradually disengaging from the material world and returning to a transcendent essence--all leading to a final fruition in which everything in the universe returns to God and finds permanent happiness. Najm al-Din al-Katibi's al-Risalah al-Shamsiyyah is a scholarly edition and translation of The Canons of Logic, with additional commentary and notes. Composed by Najm al-Din al-Katibi, a scholar of the Shafi'i school of law, al-Risalah al-Shamsiyyah is the most widely read introduction to logic in the Arabic-speaking world. It has probably enjoyed a longer shelf-life than any other logic textbook ever written, having been in use by madrasa students from the early fourteenth century up until the present day. Building on (...) the theories of Avicenna, al-Razi, and other pioneers of logic, al-Katibi discusses the many pitfalls of building arguments and setting out unambiguous claims in natural language. Qutb al-Din al-Shirazi's life spanned the last two thirds of the seventh/thirteenth centuries. A student of Nasir al-Din al-Tusi, he was involved in the revival of Peripatetic philosophy and science that occurred at Maraghah under his influence. He was significant as a transitional figure, combining Suhrawardi's Illuminative philosophy with the revived Avicennism of his teacher. His commentary on Suhrawardi's Philosophy of Illumination was the main vehicle through which this work was studied by later Iranian philosophers. He was also associated with (...) Ibn Arabi's most important student, Sadr al-Din al-Qunawi. ;Suhrawardi's Philosophy of Illumination contained a new "Science of Light", expressed largely in symbols, intended to provide a reformed basis for physics and metaphysics. Qutb al-Din frequently translated these views into Peripatetic terminology so as to make the relationships between the two systems clearer. Qutb al-Din's Pearly Crown is a popular account of philosophy, incorporating and elaborating much of Suhrawardi's philosophy but omitting or disguising the most controversial and esoteric aspects--especially those related to the World of Image, the Afterlife, and reincarnation. ;Qutb al-Din developed further the notion of the "World of Image." This "fourth world" served both philosophical and religious purposes. His ideas on reincarnation and the cyclical nature of time were especially distinctive and were developed beyond the views found in The Philosophy of Illumination. ;Also included in this dissertation are an annotated bibliography of Qutb al-Din's works and their known manuscripts and an edition and translation of his "Epistle Ascertaining the Reality of the World of Image" {Risalah fi Tahqiq )Alam al-Mithal}.
